3. Purpose of Collection
We collect and use personal and health information for the primary purpose of providing clinical assessment, treatment coordination, surgical referral, and return-to-work services. Secondary purposes include: preparing clinical documentation and reports for WorkCover WA, insurers, and legal practitioners; meeting our legal and regulatory obligations; communicating with treating practitioners and other health professionals involved in your care; and quality improvement activities conducted internally.
4. Storage and Security
Your information is stored in secure clinical record management systems with appropriate technical and administrative safeguards. Physical records are maintained in locked facilities with restricted access. Electronic records are protected by password authentication, encryption, and regular security audits. We retain health records for the minimum periods required by law, generally seven years from the date of last service (or until a patient turns 25 years of age, whichever is later). After this period, records are destroyed or de-identified securely.
5. Disclosure to Third Parties
We may disclose your personal and health information to third parties where: (a) you have provided written consent; (b) disclosure is required or authorised by law; (c) it is necessary to prevent a serious and imminent threat to life or health; or (d) it is necessary for the provision of care. Parties to whom we may disclose information include: WorkCover WA and the Insurance Commission of Western Australia, your employer or their authorised representative, private insurers and case managers, treating general practitioners and specialist surgeons, allied health professionals involved in your care, pathology and radiology providers, courts, tribunals, and legal practitioners in medico-legal matters, and hospital and day surgery facilities. We do not sell or share personal information for marketing purposes.
6. Access to Your Information
You have the right to request access to personal information we hold about you. Requests should be made in writing to our Privacy Officer at reception@phaus.au. We will respond within 30 days. In some circumstances, access may be declined where disclosure would be unlawful or would unreasonably impact another individual's privacy. A reasonable administrative fee may apply for large or complex requests.
